Questions 29

Questions asked to Shaykh Saaleh bin Fawzaan bin Abdullah al-Fawzaan [May Allaah Preserve him]
After the Explanation of the book, Zaad al-Ma'aad
18/4/1433 – 11/3/2012
Question: The author stated that an order must be executed straight away, without any delay. And the event that occurred at Hudyabah, that the Companions [May Allaah be Pleased with them all] were commanded to shave their heads and when they delayed, the Prophet [Peace and Blessings of Allah be Upon him] became angry. Is a proof of this. However, al-Juwaynee said in his book al-Waraqaat that an order that comes in the Kitaab and Sunnah can be delayed, how do we reconcile?
Answer: Juwaynee didn’t say this, all the scholars are agreed that if there is a command from the Kitaab and the Sunnah then this shows that the command must be carried out straight away unless there is an evidence to suggest that we are allowed to delay. If Juwaynee did say this, then it is a mistake from his part.
Question: Does the law and rule of one Muslim country extend to all the other Muslim countries, so if one enters a Muslim land, do the laws of the other land apply to him as well?
Answer: No, "…but if they seek your help in religion, it is your duty to help them except against a people with whom you have a treaty of mutual alliance…" [Anfaal 8:72] here Allaah has used the word 'with a people'.  As you know, today one country doesn’t have any say on how the other country is ruled. [Mumtahinah 60:10]
