Questions 28

Questions asked to Shaykh Saaleh bin Fawzaan bin Abdullah al-Fawzaan [May Allaah Preserve him]
After his explanation of the book Zaad al-Ma'aad
12/4/1433 – 4/3/2012

Question: It is mentioned in this book from the benefits we can gain from the events that occurred in Hudaybiyyah is that we are allowed to seek assistance from the Kuffar to fight enemies if there is a benefit and they are trustworthy, as ‘Uyaynah al-Khuzaa’eeah…
Answer: Yes, the Prophet [Peace and Blessings of Allaah be Upon him] sent ‘Uyaynah to the Mushrikeen, and he wasn’t a Muslim, so this is proof that we can use the Kuffar to assist us if they are trustworthy and that there is a benefit.

Question: …so how can we reconcile this with the fact that the Prophet [Peace and Blessings of Allaah be Upon him] refused to seek help from the Mushrikeen at the battle of Badr as was narrated in Saheeh Muslim?
Answer: This is abrogated as Hudaybiyyah came after Badr.

Question: Is the Emaan of Aboo as-Sideeq being weightier than the Ummaah included in the whole Ummah, from the beginning to the end or was it only the Ummah at the time of Aboo as-Sideeq?
Answer: Yes, it means the whole of the Ummah, from the beginning to the end. If we weighed the Emaan of Aboo as-Sideeq from those who came before until the end of this Ummah, his Emaan would be stronger.

Question: How do we reconcile the view of the whole of Makkah being the Haram when there is a Hadeeth in Saheeh Muslim where the wording used by the Prophet [Peace and Blessings of Allaah be upon him] said, ‘The Masjid of the the Ka’bah’? Doesn’t this mean that the reward for 100,000 multiplied prayers is only exclusive for Masjid al-Haram?
Answer: The whole of the Makkah is considered as the Masjid al-Ka’bah, my brother. The whole of the Haram is considered as the Masjid al-Ka’bah because within the Haram the Ka’bah is present; therefore it is general and not specific to one Masjid in Makkah.

Question: Does the prohibition of the Kuffar not entering the Haram include both Makkah and Madeenah, or is it Makkah alone?
Answer: No, this is only for Makkah as the Kuffar used to enter Madeenah to see the Prophet [Peace and Blessings of Allaah be Upon him], to speak to him, to make treatise with him etc. Umaamah bin Nafaal even stayed in the Masjid an-Nabawee when he was a Kaafir until he became Muslim.

Question: Does reviling or disgracing the honour of Aboo Bakr as-Sideeq mean one becomes a Kaafir?
Answer: If the person is aware of the texts praising him and despite this he says evil things about Aboo Bakr as-Sideeq, then he is a Kaafir as he has belied or disbelieved in what Allaah, the Most High, and His Messenger have informed us. However, if he doesn’t know then he is ignorant.

Question: Should we abandon those who revile Aboo Bakr?
Answer: There’s no doubt in this, abandon them.

Question: Is it permissible for a person in Ihraam to cut the hair of another who is also in Ihraam [because cutting hair during Ihraam is not permissible]?
Answer: What’s the problem? There’s no problem.

Question: What’s the difference between Tattayur [omens and superstitions] and Tafa’ul [taking precautions]?
Answer: Tatayyur is having bad thoughts about Allaah and Tafa’ul is having good thoughts of Allaah.

Question: Is the 100,00 reward for praying in Makkaah only for the Masjid al-Haraam, as the wording Masjid has been used in the hadeeth talking about the reward, and there is no mention of Makkah in its generality?
Answer: It is included, it is include, my brother. It includes the other Masaajid but the meaning of Makkaah is general, Makkah is named as a Masjid. So if you pray in Azeeziyyah or anywhere else in Makkah then you will be rewarded, as all of it is a sanctuary.  The Prophet [Peace and Blessings of Allaah be Upon him], in his final Hajj, stopped at Mu’alaat [which is in the Haram] even though he [Peace and Blessings of Allaah be Upon him] had the ability to go Masjid al-Haram. He only went to Masjid al-Haram to perform the ‘Umrah, once he performed the ‘Umrah he returned to Mu’alaat, this shows that the whole of Makkah is the same in terms of reward.

Question: Does shaving your head with a machine, grade 1 or 2 or 3, considered as shaving the head and the one who attains the three Dua’as of the Prophet [Peace and Blessings of Allaah be Upon him]?
Answer: What is referred to shaving is via the razor, so it means a total removal of hair.

Question: Is it permissible for the person doing ‘Umrah to cut his hair outside the Haram once his rituals are completed?
Answer: Yes, cutting the hair doesn’t need to be in the Haram, it can be done anywhere, even in Riyadh.

Question: The Prophet [Peace and Blessings of Allaah be Upon him] did Qunoot Naazilah for a month, does this indicate that it is only allowed for a maximum of a month?
Answer: No, it’s connected to need. You carry on doing Qunoot until once the need is over.  

Question: I bought pasta from a shop which weighed 10 kilos but I bought it by mistake so I went back and swapped it for spaghetti and the weight of the packet was heavier. Is this permissible?
Answer: No, this is Riba. It is food so when swapping food it must be like for like and hand for hand but if the type of food is different, then it is permissible. So you have to see, if the pasta and spaghetti are the same time of food in their ingredients and how they are made then it is not permissible but if they differ then it is ok, but if they differ then this is permissible. 

Question: Is it permissible to buy from a shop that sells cigarette?
Answer: It is permissible but you should advise or denounce him for selling cigerettes

Question: Is it donating blood from ongoing charity [Sadaqah Jaariyyah]?
Answer: If you donate blood to one who desperately needs it then you will be rewarded, there is no doubt in this. This is because his helping this person will be a permanents form of relief for harm that the person who needs blood is experiencing.

Question: Is one who forgets to pray a Kaafir, even if he still believes that Salaah is Waajib?
Answer: The evidence shows that one who leaves praying on purpose, look; on purpose; then he is a kaafir. If one leaves it without intent, such as the one who forgot or slept then he is forgiven.

Question: Some people when selling cars have the following transaction;  they buy a car but they don’t pay for it in full, they leave a deposit. They take the car and then sell it on, despite not having paid for it in full yet; is it permissible for them to sell it on?
Answer: If they have taken possession of the car from the owner then they can do as they wish, so it is permissible for them to sell it on even if they haven’t paid it for it in full. However, if one is paying monthly instalments and the car is not under his name yet, then he can’t sell it on because he doesn’t own it.

Question: Is it permissible for a woman to dye her hair?
Answer: If she has hair which is nice already then it’s not permissible for her to dye her hair, as her hair is already beautiful and she is dying it for no reason. Dying the hair is for those who have white hair or for those who need to beautify it. 

Question: Is the Mas’a [the area between Safaa and Marwah] from the Haram?
Answer: It is part of the Haram but it is not part of the Masjid.

Question: Is it permissible for the person to give out the inheritance of his wealth to his children whilst he is still alive? 
Answer: Yes as long as it is done according to the Shariah, such as the boy getting twice more than the girl

Question: Is it permissible for a man to give Salaam to a woman who is strange to him?

Answer: It is permissible, especially if he intends to show that he is one bringing peace. It depends on his intention, if he has a pure intention then it is permissible but if his intention is bad then this is not allowed
Question: In the hadeeth where the Prophet [Peace and Blessings of Allaah be Upon him] said, “He is not from us…”. Does this mean he is a Kaafir? 

Answer: No, it indicates a stern warning because they are not from the nullifiers of Islaam.
Question: What is the ruling on one who does Qunoot Naazilah in his Salaah but he does it quietly?

Answer: What are the followers supposed to do during the time he does this? The Sunnah is to do it aloud.
Question: Does shaving the head of the new born include both the baby boy and girl?

Answer: No we have been prohibited from shaving the head of girls, it only includes baby boys
Question: What do you say to some of the youth who say that the rulers are Kuffar because they have allied with the Kuffar?

Answer: They don’t know what allying is, they are ignorant. It is not permissible for them to talk about the Shariah and they don’t know anything.
Question: We hear many a time today that the woman is not responsible for looking after the house; she doesn’t need to cook or clean. What is the correct stance on this issue?

Answer: What happens today is the man returns home and his wife doesn’t do anything for him, the women today have become sick. The Sunnah is that the woman looks after her husband, the female Companions [May Allaah be Pleased them all] would look after their husbands, they would cook and clean and maintain the house and these are the best of women. Faatimah bint Muhammad [May Allaah be Pleased with her] would carry water on her head to the extent that it would leave marks on her body. She complained and asked her father [Peace and Blessings of Allaah be Upon him] for a maid to come and help her out, and [Peace and Blessings of Allaah be Upon him] refused. He refused to allow her to get a maid and replaced it with advice for to remains steadfast on doing Dhikr and seeking forgiveness. This is the daughter of Muhammad [Peace and Blessings of Allaah be Upon him]!
Question: Do we pray Sunnan ar-Rawaatib in Makkah if we are only there for a day or two?

Answer: If you have shortened your prayers then you should leave praying the Sunnah but if you have prayed in full then pray the Sunnah prayers.
Question: What is the ruling on buying and selling cats?

Answer: No, it is not permissible to buy and sell cats like dogs as their price has been made Haraam
Question: Is it permissible for us to take part in football competitions, the winner getting a prize?

Answer: All forms of competitions like these are not permissible, except what the Prophet [Peace and Blessings of Allaah be Upon him] made an exception for, which are swimming, archery and camel/horse-riding. Other than this is taking peoples wealth unlawfully and/or gambling.
Question: What is the ruling on one saying ‘I am Salafee’ meaning I am on the Madhab of the Salaf, but he does Jarh and says bad things about some of the scholars and he says this is from Jarh and Ta’deel?

Answer: The Muhaditheen are those who do Jarh and Ta’deel, as for backbiting and gossiping then this is Haraam and not from Jarh and Ta’deel. The Salaf themselves were cautious of doing Jarh and Ta’deel. So if one says ‘I am Salafee’, he is lying because the Salaf didn’t see it permissible to backbite others.
