-If a person doubts he
has Wudhoo then he must go with what he is certain upon or what is most likely.
Uthaymeen explains that if a person is certain that he is pure but has a doubt
whether the Wudhoo has been broken, then the principle here is that his Wudhoo
remains and no attention is paid to the doubt.
The evidence for this
principle is the Hadeeth of Aboo Hurayrah [may Allaah be Pleased with him] that
a man came complaining to the Prophet [Peace and Blessings of Allaah be upon
him] about doubts that he has about passing wind so he said, “Do no pay
attention to your doubts unless you hear a sound or smell a smell.” In another
narration he said, “Nothing has come out of you unless you hear…”
The Prophet [Peace and
Blessings of Allaah be upon him] also said, “If anyone of you doubts about his
Salaat, then cast aside the doubt and act upon what he is certain upon.”
[Reported by Muslim (571)]
A-The same applies to
Ghusl. So if a person wakes up and finds himself wet yet he knows he didn’t
have an erotic dream but now he is not sure if it is semen or not, then there
is no Ghusl for him as he is certain that he didn’t have an erotic dream.
B-The opposite is also
true – if a person is certain or thinks very likely that he doesn’t have Wudhoo
but has an inkling that he has Wudhoo, then in origin he has no Wudhoo as this
is what he is certain or most likely upon.
NOTE: this point is
known as Qiyaas al-Aks (opposite analogy) which some scholars denied. The proof
for this principle is the Hadeeth of Aboo Hurayah above and also the Hadeeth in
which the Prophet described the relations one has with his wife a being a
Sadaqah to which the Companions were surprised and then the Prophet said, “Do
you not see if you were to have relations with other than your wife you would
be sinful?...Likewise, having relations which with what is Halaal for you has a
reward.” [Reported by Muslim (1006)]
So this principle is
extremely important and there are many issues which have been built upon it in
issues of Fiqh.
Likewise, it solves
several problems faced by many people – they have doubts in purity, in their
Salaat, in matters of Talaaq, contracts etc.
If a person pays
attention to this principle in his life, then the doors for Waswasa and doubts
will be closed due to the blessings of the statements and wisdom that the
Prophet [Peace and Blessings of Allaah be upon him] came with.
Additionally, this
principle illustrates the compassion found in al-Islaam; it wishes to remove
stress, worry and doubt from mankind. Moreover, it wants mankind to act upon
what is clear and apparent. So if a person uses this principle as a standard in
his life then you will find this person being upright, because the Shaytaan
wishes to create anxiety, fear and doubts through his Waswas. Shaytaan doesn’t
stop in matters of purification either, this is what he often starts with and
then moves on to as-Salaat, as-Siyaam and so on, until his whole life is based
on doubts and conjecture.
So the Legislator
(i.e. Allaah) has closed all paths that lead to Waswas and has eradicated it
from its very origins by Commanding us not to pay attention to doubts lest it affects
the make-up of a person.
