Khabr Waahid: Introduction of Saheeh Muslim of an-Nawawee (Part 5)

The majority say Khabr Wahid is Dhunn but necessitates acting upon it if it's proven
Dhahirees and Mutazilah say it's never knowledge and not acted upon.

Al-Qadariyyah, ar-Raafidah, the Mu’tazilah and some Dhahirees said we reject it based on 'Aql whilst others say they reject it based on Daleel (i.e. the conditions of it reaching the level of Ilm have not been met).

The Mu'tazilah say it must be at least narrated two by two in each part of the chain, such as al-Jubaa’ee.

Nawawee states that the correct view is that it's 'Ilm as the Prophet (Peace and Blessings of Allaah be upon him) sent messengers by themselves, and the Khulpha after him did the same, likewise the Salaf. Also, 'Aql doesn't negate acting upon Khabr Waahid.

Lying with the Mu'tazilah is Based on Qasd Alone: Introduction of Saheeh Muslim of an-Nawawee (Part 4)

Lying is going against the truth or covering up what is factual

The Mu’tazilah say there must be Qasd, otherwise its not a lie

Nawawi said its still a lie but one may not be sinful if he doesn’t have the intention or he makes a mistake

Principles on al-Jarh wa at-Ta’deel Taken from the Introduction of Sharh Muslim of an-Nawawee (Part 3)

-Jarh is Waajib for the one who is able, it’s from Naseehah to the Muslim.

-Jarh and Ta'deel must be done with accurate information and not to be too lenient or too harsh. 

-If a person is not qualified then he is not allowed to part take in Jarh wa Ta’deel.

-If he is not Adil it Dabit himself then he is not allowed to either.

-There is no set number rather Jarh or Ta'deel can be accepted from just one scholar, as it's a form of Khabr and Khabr Waahid is acceptable from a trustworthy source.

-The Shafi'ees say that Jarh must be detailed, others said not, whilst others said it must be detailed if it's not an Imam.

-Jarh is given precedence to Ta'deel only if both are Mufasaar.

-Some said we follow the greater in number.

The correct view in matters of Jarh or Ta'deel is to follow the evidence.

Benefits From the Introduction of Saheeh Muslim: Reason for Quoting Weak Narrations (Part 2)

Weak narration were transmitted so that:

-We can have a record of what is Saheeh and Da'eef (and in between).
-At certain times, we can use weak narrations as support other Ahaadeeth.
-So that we can compare which narrations and texts are stronger in Diraayah and Riwaayah, (thus sieving out what is Shaadh etc.).
-That they maybe used elsewhere as supporting, such as in matters of at-Targheeb and at-Tahreeb or in stories etc.

Benefits Taken from the Introduction of Saheeh Muslim: Ruling on Using Weak Ahaadeeth and Fabricating Them (Part 1)

‘Indeed what prevents me from relating to you a great number of Ḥadīth is that the Messenger of Allah, peace and blessings of Allah upon him, said: ‘Whoever intends to lie upon me, then let him take his seat in the Fire.’ [Hadeeth No. 2 from the Introduction of Saheeh Muslim]

-It is haram to use weak/fabricate reports and attribute them to the Prophet (Peace be upon him) to the level of it being kufr, some said it was Kufr.

-The person is also sinful even if he was ignorant

-Ahl as-Sunnah say it's a sin whether he intends it or not.

Mu'tazilah say there must be Qasd to lie 

In response we say “Whoever lies upon me” (من كذب علي) is general as are other narrations which are also general, thus we don’t make a restriction (تقييد) of “on purpose” (عمد), and this is specific to the prophet otherwise lying is only with if a person intended it.

-Lying against the Prophet is not Kufr as all the narrations combined show it's a major sin 
without using the word Kufr, other wordings include ((يلج)) ((بني له بيت)) ((يدل)) etc.

-Lying against him making it permitted to lie is Kufr, with no disagreement

-If a person lies and fabricates and makes Tawbah his narrations are accepted, Qiyaas with those who were Kuffaar and became Muslim and accepting Shahaadah (there is Ijmaa on this) of a person after he repents from lying, this is the view of the majority.

Those who said its not allowed to accept it make Qiyaas between Riwaayah and Shahaadah because Riwaayah is general Mafasadah against the Prophet but Shahaadah is specific for a case, but in response we say Tawbah is accepted for all sins including Kufr and narrations are accepted thereafter

-The scholars are agreed that it is not permitted to lie against him Ahkaam nor in Targheeb, except for what a few Juhaal said. They permitted lying and fabricating in matters of Targheeb as they argue that they are lying for him, not against him and there is a wording which says ((ليدل الناس))

In response, ((لا تخفوا ما ليس لكم به علم)), its innovating, its Zoor and they are going against Mutawatir and Ijmaa, also linguistically one can’t lie for a person (له) whilst fabricating against him, it’s always against (عليه)

As for the wording ((ليدل الناس)) then this is for تأكيد, but the extra wording is weak with no disagreement.

-The scholars are agreed that narrating these weak narrations is not permissible except for conditions: 1) to explain or 2) it must be clearly stated that it is weak or fabricated

-The scholars are agreed that Tasheeh and Tad’eef is Ijtihaad but if you disagree with the grading you don’t need to change it but make a note as this would all lead to Tahreef

-It is permitted to narrate a Hadeeth if one says ((كماقال)) or with ((بمعنى)), there is agreement that this is not false attribution, this is why Anas and Zubayr were plentiful in Mawqoof Ahadeeth because they feared false attribution

Introduction to the New Tag of Sharh Saheeh Muslim Series

بسم الله الرحمن الرحيم

This tag - by the Permission and Grace of Allaah - will display benefits taken from the Sharh of Saheeh Muslim by the well-known Imaam, Aboo Zakariyyah Yahya bin Sharaf an-Nawawi (d.676) - may Allaah have Mercy on him.

We aim to cover the whole book with this extensive series. 

Shaykh al-'Allaamah Muhammad al-'Uthaymeen [may Allaah have Mercy on him] said about Imaam Aboo Zakariyyah an-Nawawee, 

"(An-Nawawi and Ibn Hajar) are from the 'Ulema that have benefitted them Ummah a great deal. Even if they have erred in certain areas of Ta'weel, they are forgiven because of their virtues and the great deal of benefit they have left behind. 

I believe that the mistakes that they may have made is only a result of Ijtihaad and I hope in Allaah, the Most High, that they will be forgiven for this. However, they remain as those who left behind a great deal of good and benefit - for this there is gratitude for. 

As for my opinion, I hold them both to be from Ahl as-Sunnah wal Jama'aah. 

The proof is that they may have erred on a few issues of Ta'weel of Sifaat, however their service to the Sunnah and its Ahkaam is proof that they were upon the way of following the Sunnah. 

As for making mistakes in al-'Aqeedah, then if a person makes a mistake and differs from the way of Ahl as-Sunnah then he is misguided, without doubt.

However, we cannot state that a person is misguided until the Hujjah is established against him. Once the Hujjah has been presented and explained, and the person continues to differ with the Salaf, only then a person can be classed as an innovator in the matters which he has differed in - as now he has opposed the truth - otherwise, in the rest of affairs he is Salafee. 

Therefore, a person cannot be classed as an innovator wholeheartedly, or as a Salafee wholeheartedly. Rather, we describe such a person as being Salafee in which he conforms to the truth in and an innovator in which he differs with the Salaf upon. 

Just as the (well-known) view of Ahl as-Sunnah on the ruling of a Faasiq is that he is a believer in relation to his Emaan and has Fisq in relation to his sins. Therefore, it is not possible to place a comprehensive Hukm upon such person - complete affirmation and complete negation. This is the justice Allaah has Commanded."

Shaykh al-Allaamah Hammaad al-Ansaaree [may Allaah have Mercy on him] said about those who call to boycott an-Nawawee:

"Had I had some sort of power I would imprison those who call to boycotting Fath al-Baaree and Sharh Muslim, indefinitely imprisoning them until they repent." [al-Majmoo' (2/582)]
